If you are visiting the Broads this bank holiday weekend please have a safe one.

Over the coming months we will be highlighting questionable behaviour caught on CCTV at our Yacht Stations to help raise awareness of the dangers of the water.

In this clip filmed at Norwich Yacht Station in 2019, some hirers visiting the area on holiday are towing a child behind their boat in an inflatable without a care in the world.

This is unsafe on the Broads at the best of times, but even more dangerous is that those skippering the boat didn't turn back once to make sure the daughter was safe, and then proceeded to turn the large craft around in the channel outside Pull's Ferry with daughter still in tow.

A very bad idea considering the proximity of fast-moving prop on the back of the boat to the inflatable, the possibility of the inflatable's line obstructing other river users, and that fact that the daughter could capsize easily without them knowing.

Broads Authority Quay Assistant Dave attempted to highlight the dangers of the situation to the skipper, but to no avail.

The video was recorded 2 years ago. Why has it only just been published? I don't suppose it's anything to do with the BNA trying to impress the MAIB that they are serious about water safety. I hardly think 'naming and shaming' in this fashion is appropriate.

The logic of posting it is explained in the post above and looking at the Facebook comments it has got people thinking about the risks which I suppose is what they wanted.

Also given that no one is named, how is it ‘naming and shaming’??

‘Naming and shaming’ is simply a generic term for the BNA’s behaviour. From the video clip that has been published, the name of the hire boat can be seen, as well as the time and date of the incident. The faces of the two people on the boat can be seen clearly enough to be identified (including the helmsman). It would be a simply matter to identify them. I wonder what the Information Commissioner would have to say about it. Rules on the use of CCTV  data are very strict.

Fair enough - I think I will drop them an email about it. Hadn’t thought it was very clear but perhaps my eyesight is a bit naff!!

Out of interest what are the legalities with things like the various online Broads webcams paladine?

I like the idea of this though, seems to have had success with other councils ‘shaming’ things like vans fly tipping commercial waste. If anything it’ll raise awareness hopefully.

Each case would be judged separately. It very much depends on whether the installation is by a private individual or by a business/organisation; has the installation been registered; what is the purpose of the installation; are any data recorded; what is the purpose for which that data are recorded; has the data been used for some other purpose, etc.

There is a useful guide on the ICO web site https://ico.org.uk/media/for-organisations/documents/1542/cctv-code-of-practice.pdf Of particular note are the sections relating to disclosure and retention of the data.

Data protection is something of a minefield, and the BNA might just have stepped onto a mine.

Well, it seems that someone in the BNA takes note of what we say. That non-compliant video has now been edited to blur the faces of the holiday-makers, and the time and date have been removed. I hope someone got a talking to.
